Under the deal, the private equity group Avenue Capital would take over control in a debt-for-equity swap that would end Rick Schaden's controversial ownership of the concept.

The deal would shave $281 million off of the chain's $875 million in debt, and includes an equity injection of $150 million, half of which would go to market the brand.
